Court says immigration status does not influence workers’ compensation eligibility
Illinois workers’ compensation law is designed to help all workers who are injured or become ill on the job, regardless of immigration status. When he invoked his Fifth Amendment rights and refused to state whether he was residing legally in the country, a judge suspended his workers’ compensation benefits. In a recent ruling, the state Supreme Court reversed this decision, declaring that Cruz was eligible for benefits and could not be denied because of his unresolved immigration status.

This new ruling sets an important precedent for immigrant workers in Illinois. It shows that injured workers can apply for benefits regardless of legal status.
